IdleSpots, Inc. — Terms of Service
Please read these Terms carefully. Section 24 contains a binding arbitration agreement and class action waiver that affect how disputes are resolved. You may opt out of arbitration within 30 days as described in Section 24.
These Terms of Service ("Terms") are a binding agreement between you and IdleSpots, Inc. ("IdleSpots," "we," "us," or "our"). By creating an account, making or accepting a Booking, or otherwise using the IdleSpots mobile apps, the website at idlespots.com, or related services (together, the "Platform"), you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Platform.
"Booking" means a limited, revocable license granted by a Host to a Driver to enter and park one vehicle in a specific Parking Spot during the confirmed booking window. A Booking is not a lease, rental agreement, or property interest, and it does not create a bailment.
"Building Partner" means a property owner, property manager, or homeowners' association that has signed a separate partnership agreement with IdleSpots.
"Driver" means a Member who books a Parking Spot.
"Host" means a Member who lists a Parking Spot. Where a Building Partner lists Parking Spots, references to a Host include that Building Partner.
"Listing" means a Parking Spot offered for Booking on the Platform, together with its description, photos, price, rules, and access instructions.
"Member" means any person who has registered an account on the Platform.
"Parking Spot" means a designated space for parking a single motor vehicle.
"Parking Operator" means the Host and, where applicable, the Building Partner or other owner or manager of the property where the Parking Spot is located.
"Prohibited Vehicle" and "Unauthorized Parking" have the meanings given in Section 11.
IdleSpots operates an online marketplace that connects Hosts who have parking spaces available with Drivers who need parking. IdleSpots provides the technology that lets Members list, find, book, pay for, and in some locations access Parking Spots.
IdleSpots is not a party to the Booking between a Host and a Driver. IdleSpots does not own, lease, operate, or control any Parking Spot or parking facility; does not take custody or control of any vehicle or its contents; does not provide attendant or valet services; and is not a broker, agent, or insurer of any Member. IdleSpots does not guarantee the condition, safety, legality, or suitability of any Listing, although we may remove Listings or Members that violate these Terms.
You must be at least 18 years old to use the Platform. You agree to provide accurate, current, and complete information and to keep it up to date. You may hold only one account. If we find duplicate accounts, including accounts created to avoid a suspension, we may close all of them.
You are responsible for all activity under your account and for keeping your login credentials confidential. Tell us right away at [email protected] if you believe your account has been used without your permission.
We may update these Terms from time to time. When we do, we will post the updated Terms on the Platform and update the "Last updated" date. If a change materially reduces your rights or increases your obligations, we will give you at least 30 days' advance notice by email or in-app message before it takes effect. Changes will not apply to Bookings confirmed before the change takes effect, and changes to Section 24 will not apply to any dispute of which IdleSpots had notice before the change. If you continue to use the Platform after a change takes effect, you accept the updated Terms. If you do not agree, stop using the Platform and you may close your account.
By creating a Listing, you represent and warrant that:
you have the legal right to offer the Parking Spot, including any consent required from the property owner, landlord, property manager, or HOA;
the Listing does not violate any lease, CC&Rs, HOA rules, loan covenant, zoning ordinance, permit, or condition of approval;
all Listing information, including dimensions, access instructions, and rules, is accurate and kept up to date; and
you will comply with all laws that apply to your Listing, including tax, zoning, and private-property towing laws.
Hosts agree to honor every confirmed Booking, keep the Parking Spot clear and accessible during the booking window, never charge a Driver more than the confirmed Booking price, and never request or accept payment outside the Platform.
If a Host cancels a confirmed Booking, or the Parking Spot is unavailable when the Booking begins, the Driver will receive a full refund. Repeated Host cancellations may lead to loss of payouts for the affected Bookings, lower placement of Listings, or suspension or removal of the Host's account.
Hosts receive the Booking price less the IdleSpots platform fee, any applicable building fee, and any adjustments for refunds or chargebacks. The fees that apply to you are shown in your Host dashboard before you publish a Listing. Payouts are made through Stripe Connect, generally on a weekly schedule. To receive payouts, Hosts must complete Stripe's onboarding and agree to the Stripe Connected Account Agreement, which includes the Stripe Services Agreement. IdleSpots may hold a payout while we investigate suspected fraud, a dispute, or a violation of these Terms.
Hosts are independent users of the Platform. Hosts are not employees, agents, contractors, joint venturers, or partners of IdleSpots, and nothing in these Terms creates such a relationship. Hosts decide whether and when to list, and set their own prices and spot rules within the Platform's guidelines.
Hosts are responsible for maintaining any insurance required by their lease, HOA, or lender. We recommend that Hosts confirm with their insurer that their property and liability coverage applies to parking use by others.
IdleSpots may remove, suspend, or limit a Listing at any time if we believe it is inaccurate, unsafe, unlawful, the subject of repeated complaints, or otherwise in violation of these Terms.
Building Partners are also bound by their partnership agreement with IdleSpots. If that agreement conflicts with these Terms, the partnership agreement controls as between IdleSpots and the Building Partner.
To book a Parking Spot, you must:
be at least 18 years old and hold a valid driver's license;
carry auto liability insurance that meets at least the minimum required by the state where the vehicle is registered. For California, the minimum is currently $30,000 per person / $60,000 per accident for bodily injury and $15,000 for property damage;
complete identity verification before your first Booking (see Section 16); and
follow the access instructions and spot rules shown in each Listing.
You are responsible for:
checking that the date, time, and location of your Booking are correct before you confirm it;
registering the make, model, color, and license plate of the vehicle you will park before the Booking starts. If someone else will park under your Booking, register their vehicle the same way. Temporary or dealer plates must be registered with the plate number shown;
making sure you have received the in-app Booking confirmation before you park; and
parking entirely within the marked boundaries of your assigned Parking Spot.
A vehicle that is not registered to an active Booking may be treated as Unauthorized Parking.
A Booking may be used only by you or by a person you have authorized to park the registered vehicle. You may not sell, transfer, sublet, or advertise a Booking or any access credential on any other website, app, or marketplace.
Unless the Parking Operator has given prior written approval, you may not:
park more than one vehicle in a Parking Spot;
store any items other than your parked vehicle in the Parking Spot;
carry out any vehicle maintenance, repair, or washing in the Parking Spot; or
sleep or live in a vehicle parked in the Parking Spot.
You must leave the Parking Spot by the end of your booking window, or extend your Booking in the app before it ends, subject to availability.
At some properties, IdleSpots connects with the building's gate or access control system to provide a digital access credential that works only during your booking window. At other properties, access instructions are shown in the Listing.
Access credentials are personal to the Booking. You may not share, copy, or use them outside the booking window or for anyone other than the registered vehicle.
If you cannot get in during an active Booking, contact IdleSpots support through the app or at [email protected] right away. We will use commercially reasonable efforts to restore access or arrange an alternative. If access cannot be provided, you will receive a refund as described in Section 14. IdleSpots does not guarantee uninterrupted gate access, and is not responsible for failures of building infrastructure, third-party access systems, or connectivity at the property, except for the refund described in Section 14.
A Parking Operator may occasionally need a Parking Spot for repairs, repainting, cleaning, an emergency, or a similar building need. When that happens, we will try to notify affected Drivers in advance and offer a comparable alternative Parking Spot. If no comparable alternative is offered or accepted, the Driver will receive a refund for the affected time.
Report any problem with your Booking through the app as soon as you discover it. Problems include another vehicle in your Parking Spot, an obstruction, or being unable to get in.
If another vehicle is in your Parking Spot, report it in the app and follow the in-app instructions. These may include moving you to an alternative Parking Spot. Please do not park in another space unless the app or support directs you to, because parking in an unassigned space may be treated as Unauthorized Parking.
Problems reported within one hour after the Booking start time are eligible for a full refund. Problems reported later are eligible for a refund of the unused time. Parking you book or pay for outside the Platform while a problem is being resolved is not reimbursed unless IdleSpots support approved it in advance.
Knowingly submitting a false problem report is a violation of these Terms and may lead to account suspension or termination.
The following may not be parked in any Parking Spot:
inoperable, unregistered, or salvage vehicles;
commercial trucks, box trucks, buses, and other vehicles over the size limits stated in the Listing;
trailers, RVs, campers, boats, or any vehicle being towed;
vehicles carrying hazardous materials or displaying hazardous materials placards;
vehicles without a valid license plate (or registered temporary plate); and
any vehicle prohibited by law or by the rules shown in the Listing.
Unauthorized Parking includes:
parking without an active Booking for that Parking Spot and that vehicle;
parking outside the lines of the Parking Spot;
blocking a drive aisle, gate, another space, or a pedestrian walkway;
parking in a fire lane or emergency access area;
parking in an accessible (disabled) parking space without a valid placard or plate;
parking in any access aisle (the striped area next to an accessible space), which is not permitted for any vehicle;
parking a Prohibited Vehicle; or
parking more than one vehicle in a Parking Spot without written approval.
The following fees reflect a reasonable estimate of the costs that Hosts, Parking Operators, and IdleSpots incur from violations. These include staff time, lost bookings, and enforcement costs, which are difficult to calculate exactly. They may be charged to the payment method on your account after notice to you:
Parking outside the lines, or a minor blocking violation: $50 per occurrence.
Parking without an active Booking, or in an unassigned space: $75 per occurrence, plus the standard rate for the time parked.
Prohibited Vehicle, fire lane, or blocking another Booking or a gate: $150 per occurrence.
Repeated violations within 12 months: up to $300 per occurrence.
Damage to a Parking Spot or property: the reasonable, documented cost of repair.
We will tell you about any violation fee in writing, along with a description of the violation and any supporting photos or records. You may dispute a violation fee by replying to the notice or emailing [email protected] within 14 days. We will review your dispute in good faith and tell you the outcome.
A vehicle involved in Unauthorized Parking or that is a Prohibited Vehicle may be removed by the property owner or its authorized agent at the vehicle owner's expense. Removal will follow California Vehicle Code Section 22658 and other applicable laws, including posted-signage requirements. Hosts and Parking Operators are responsible for ensuring that any towing they authorize complies with the law. IdleSpots does not itself tow vehicles.
Serious or repeated violations may lead to suspension or permanent removal from the Platform.
Before you confirm a Booking, the checkout screen shows the total price. This includes the spot rate, the IdleSpots service fee, and any taxes. By confirming, you authorize IdleSpots, through its payment processor Stripe, to charge that total to your selected payment method.
Hourly, daily, and event Bookings are charged in full when you book. Recurring monthly Bookings, where offered, are charged as described in Section 13.
If a payment fails, we may cancel the related Booking after notifying you. If a payment from a linked bank account is returned unpaid, we may charge a returned-payment fee of $15, as permitted by law.
If you think a charge is wrong, please contact us first at [email protected] so we can fix it quickly. You keep any rights you have under law and your card agreement to dispute a charge with your card issuer. While a payment dispute is open, we may pause future Bookings on the account. We may suspend or terminate accounts that file chargebacks we reasonably determine to be fraudulent.
Refunds are returned to the original payment method. Some banks and card issuers cannot accept refunds to closed accounts or for older charges. If that happens, contact support and we will work with you on an alternative.
Where required, IdleSpots collects and remits parking taxes on Bookings. This includes the City of Los Angeles Parking Occupancy Tax (currently 10%). Taxes are included in or shown with the price at checkout. Hosts are responsible for their own income taxes and any other taxes on their earnings. IdleSpots or Stripe will issue IRS Form 1099-K to Hosts who meet the IRS reporting thresholds. To make that possible, Hosts must provide accurate taxpayer information.
If you choose a recurring monthly Booking, it will automatically renew each month and your payment method will be charged the monthly price shown at checkout on each renewal date until you cancel. Before you confirm, we will show you the monthly price, the renewal date, and how to cancel. We will ask for your express consent to the automatic renewal, and we will send you a confirmation that includes this information and how to cancel.
You can cancel a recurring Booking at any time, online, in the app under your Booking or account settings. Cancellation takes effect at the end of the current paid month unless the Listing states otherwise at checkout. If the monthly price is going to change, we will notify you at least 7 days before the change and before you are charged, and tell you how to cancel.
Any fixed-term monthly Booking that cannot be canceled early, or that carries an early termination fee, will be clearly identified as such at checkout. Any such early termination fee will not exceed the lesser of one month's price or $100.
Driver cancellation before the start time: You may cancel an hourly, daily, or event Booking in the app at any time before it starts and receive a full refund to your original payment method.
After the start time: Once a Booking has started it is non-refundable, except as described in this Section.
Host cancellation or unavailable spot: If the Host cancels, the Parking Spot is unavailable, or you cannot get in because of an access failure that is not your fault, you will receive a full refund. We may also offer an alternative Parking Spot.
Problems reported during a Booking: Refunds are handled as described in Section 10.
Errors: If a Booking was created or priced because of a clear technical error, we may cancel it and give a full refund.
Nothing in these Terms limits any refund right you have under applicable law.
If your vehicle remains in a Parking Spot after your booking window ends and you have not extended your Booking ("Overstay"), you will be charged the overstay rate shown in the Listing and at checkout. The charge is billed in 15-minute increments from the end of your Booking. We will notify you before your Booking ends so you can extend it in the app if the spot is available. Overstay charges are billed to your payment method on file.
If an Overstay prevents another Driver's confirmed Booking, the vehicle may also be treated as Unauthorized Parking under Section 11. Repeated Overstays may lead to account suspension.
Drivers must complete identity verification through our third-party provider before their first Booking. We may refuse or cancel a Booking, or close an account, if verification fails or the information provided is false.
A "verified" badge means only that the Member completed our verification process. It does not confirm a Member's character, background, driving record, or suitability. IdleSpots does not endorse any Member or Listing. Please use good judgment in your dealings with other Members.
Search results and Listing order are based on factors such as location, availability, price, ratings, and relevance, and may change over time.
IdleSpots maintains business insurance, which may include general liability, technology errors and omissions, cyber liability, and contingent auto liability coverage. Contingent auto liability coverage may apply to certain third-party claims arising during an active Booking when a Driver's own auto insurance does not respond or is exhausted.
All IdleSpots insurance is subject to the terms, conditions, limits, and exclusions of the actual policies. These Terms are not an insurance policy, and IdleSpots is not an insurer. Your own auto insurance is primary at all times. Unless a separate written protection program offered by IdleSpots expressly says otherwise, IdleSpots insurance does not cover loss of or damage to your own vehicle or its contents. Coverage does not apply to Prohibited Vehicles, Unauthorized Parking, or incidents caused by a violation of these Terms.
If a Driver damages a Parking Spot or property, or a Host believes a Driver caused damage, report it through the app or to [email protected] within 72 hours with photos and any supporting information. IdleSpots may help the Members communicate and resolve the claim. With notice to the Driver and an opportunity to respond, IdleSpots may charge the Driver's payment method for the reasonable, documented cost of damage the Driver caused.
Some participating properties have security cameras installed by IdleSpots or the Parking Operator. These cameras record video, never audio, of vehicle arrivals, departures, and activity at the Parking Spot. Where cameras are present, the Listing will say so and signage will be posted at the location. Footage is used for security, to verify Bookings, to resolve disputes and damage claims, and to enforce these Terms, as described in our Privacy Policy. Hosts and Building Partners must post the signage IdleSpots provides at each camera location before the first Booking.
From time to time, IdleSpots or a Building Partner may offer validation codes or promotional discounts. Each offer is subject to the terms shown with it. Unless the offer states otherwise:
one code or discount may be used per Booking, and codes cannot be combined;
a validation must be applied within 24 hours after the Booking ends, and cannot be switched once applied;
codes have no cash value and cannot be sold or transferred; and
codes may expire, and we may end an offer at any time, without affecting any discount already applied to a confirmed Booking.
Using a code in violation of its terms may lead to the discount being reversed and, for repeated or deliberate misuse, account suspension.
You agree not to:
violate any law or the rights of others;
harass, threaten, stalk, or harm any person;
impersonate any person, or misrepresent your identity or authority to list a Parking Spot;
request, make, or accept payment for a Booking outside the Platform;
share, sell, or misuse access credentials, or resell Bookings;
hold more than one account;
submit false problem reports, reviews, or damage claims;
copy, scrape, reverse engineer, or interfere with the Platform or its security, or introduce malicious code; or
use the Platform in any way that violates Sections 7 or 11.
The Platform, including its software, design, text, and the IdleSpots name and logo, belongs to IdleSpots, Inc. and is protected by intellectual property laws. We give you a limited, personal, non-transferable right to use the Platform under these Terms. You may not use IdleSpots trademarks without our written permission or suggest that IdleSpots endorses you.
You keep ownership of content you submit, such as Listing photos, descriptions, and reviews. You grant IdleSpots a non-exclusive, worldwide, royalty-free license to host, display, reproduce, and adapt that content to operate and promote the Platform. Reviews must be honest and based on a real Booking. We may remove content that violates these Terms. If you send us suggestions or feedback, we may use them without obligation to you.
Copyright complaints: If you believe content on the Platform infringes your copyright, send a notice to our designated agent at IdleSpots, Inc., Attn: Copyright Agent, 16530 Ventura Blvd, Suite 516, Encino, CA 91436, or [email protected]. Your notice must include:
your physical or electronic signature;
identification of the copyrighted work and of the material you believe infringes it, including where it is located on the Platform;
your contact information;
a statement that you have a good-faith belief the use is not authorized; and
a statement, under penalty of perjury, that the notice is accurate and that you are authorized to act for the copyright owner.
You may close your account at any time in the app's account settings. We may suspend or terminate your account, or cancel Bookings, if we reasonably believe you have:
violated these Terms;
engaged in fraud or misused access credentials;
created a safety risk; or
caused harm to other Members, Parking Operators, or IdleSpots.
Where appropriate and lawful, we will tell you the reason and give you an opportunity to respond. If we cancel a future Booking for a reason that is not your fault, you will receive a full refund. Sections that by their nature should survive termination will survive, including fees owed, Sections 17 and 22, and Sections 24 through 28.
Most concerns can be resolved quickly through [email protected]. Before starting arbitration or a court case, you and IdleSpots each agree to send the other a written notice describing the dispute and the relief requested. Notices to IdleSpots go to IdleSpots, Inc., Attn: Legal Department, 16530 Ventura Blvd, Suite 516, Encino, CA 91436, or [email protected]. Both parties will then try in good faith to resolve the dispute for 60 days.
If the dispute is not resolved, you and IdleSpots agree that any dispute arising out of or relating to these Terms or the Platform will be resolved by final and binding individual arbitration, except as stated below. The arbitration will be administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules, which are available at adr.org. A single arbitrator will hear the case. Hearings may be held by video, by phone, or in person in the county where you live or in Los Angeles County, California. IdleSpots will pay all AAA filing, administration, and arbitrator fees for claims you bring, except as the AAA rules provide where a claim is found to be frivolous. The arbitrator may award any individual relief a court could award, and the Federal Arbitration Act governs this Section.
Either party may bring an individual claim in small claims court if it qualifies. Either party may also go to court for claims about intellectual property infringement or misuse. Nothing in this Section prevents you from bringing issues to the attention of government agencies. Claims for public injunctive relief under California law will not be arbitrated. Any such claim will be decided by a court after the individual claims are resolved in arbitration.
You and IdleSpots each agree to bring claims only in an individual capacity, not as a plaintiff or class member in any class, collective, or representative proceeding. The arbitrator may not consolidate claims of different people. If this class action waiver is found unenforceable as to a particular claim, that claim must be decided in court and not in arbitration.
If 25 or more similar arbitration demands are filed by or with the help of the same law firm or organization, the cases will be administered under the AAA's Mass Arbitration Supplementary Rules.
By agreeing to arbitration, you and IdleSpots each give up the right to a jury trial for claims that are arbitrated.
You may opt out of this arbitration agreement by emailing [email protected] within 30 days after you first accept these Terms. Your email should include your name, the email address on your account, and a clear statement that you are opting out of arbitration. Opting out does not affect any other part of these Terms.
If any part of this Section 24 is found unenforceable, the rest will remain in effect, except as stated in Section 24.4.
TO THE FULLEST EXTENT PERMITTED BY LAW, THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED. THIS INCLUDES IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. IDLESPOTS DOES NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED OR ERROR-FREE, OR THAT ANY LISTING IS ACCURATE, SAFE, OR SUITABLE. EXCEPT TO THE EXTENT CAUSED BY IDLESPOTS' OWN NEGLIGENCE OR MISCONDUCT, IDLESPOTS IS NOT RESPONSIBLE FOR THEFT OF OR DAMAGE TO ANY VEHICLE OR ITS CONTENTS, OR FOR THE ACTS OR OMISSIONS OF HOSTS, DRIVERS, PARKING OPERATORS, OR OTHER THIRD PARTIES.
TO THE FULLEST EXTENT PERMITTED BY LAW:
IDLESPOTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS OR DATA; AND
IDLESPOTS' TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE PLATFORM WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID TO IDLESPOTS IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) $100.
THESE LIMITS DO NOT APPLY TO LIABILITY FOR FRAUD, GROSS NEGLIGENCE, WILLFUL MISCONDUCT, DEATH OR PERSONAL INJURY CAUSED BY IDLESPOTS' NEGLIGENCE, OR ANY LIABILITY THAT CANNOT BE LIMITED UNDER APPLICABLE LAW.
To the extent permitted by law, you agree to defend, indemnify, and hold harmless IdleSpots and its officers, directors, employees, and agents from third-party claims, losses, and reasonable attorneys' fees arising out of:
your breach of these Terms;
your violation of any law or third-party right;
Unauthorized Parking, a Prohibited Vehicle, or an Overstay involving your Booking or vehicle; or
if you are a Host, your Listing, including any misrepresentation of your authority to list it.
Disputes between Members are between those Members. To the extent permitted by law, you release IdleSpots from claims arising from the conduct of other Members or Parking Operators. This release does not cover IdleSpots' own fraud, gross negligence, willful misconduct, or violation of law. If you are a California resident, you waive California Civil Code Section 1542 for this release only. Section 1542 says: "A general release does not extend to claims that the creditor or releasing party does not know or suspect to exist in his or her favor at the time of executing the release and that, if known by him or her, would have materially affected his or her settlement with the debtor or released party."
These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws rules, except that the Federal Arbitration Act governs Section 24. For any dispute that is not arbitrated, you and IdleSpots agree to the exclusive jurisdiction of the state and federal courts located in Los Angeles County, California.
By adding your phone number, you agree to receive transactional text messages from IdleSpots about your account and Bookings. These include confirmations, access instructions, reminders, overstay alerts, and support messages. Message frequency varies with your activity. Message and data rates may apply. Reply STOP to unsubscribe or HELP for help. Carriers are not liable for delayed or undelivered messages. We will send marketing text messages only if you separately opt in, and consent to marketing messages is not a condition of any purchase. If you opt out of transactional texts, you will still receive Booking details and access instructions in the app.
You agree that we may provide notices, disclosures, and agreements to you electronically, by email, in the app, or on the Platform. Your electronic acceptance of these Terms and confirmation of any Booking is your signature and your agreement to be bound and to pay the amounts shown.
If you download our app from the Apple App Store or Google Play, these Terms are between you and IdleSpots only, not Apple or Google. Apple and Google are not responsible for the app or its content, and have no obligation to provide maintenance or support. If the app fails to conform to any applicable warranty, you may notify Apple and Apple may refund the purchase price, if any. To the maximum extent permitted by law, Apple has no other warranty obligation. Apple is not responsible for any product claims, third-party intellectual property claims, or legal compliance claims relating to the app. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. You represent that you are not located in a country subject to a U.S. government embargo and are not on any U.S. government list of prohibited or restricted parties.
Entire agreement: These Terms, the Privacy Policy, and any terms shown at checkout or in a Listing, and for Building Partners their partnership agreement, are the entire agreement between you and IdleSpots about the Platform.
Severability and waiver: If any provision is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver.
Assignment: You may not transfer these Terms without our consent. We may assign them in connection with a merger, acquisition, or sale of assets.
Force majeure: We are not responsible for delays or failures caused by events beyond our reasonable control. Any refund owed to you under Section 14 for a Booking that could not be provided is not affected.
No agency: No agency, partnership, joint venture, employment, or franchise relationship is created by these Terms.
California consumers: Under California Civil Code Section 1789.3, California users may contact the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs in writing at 1625 North Market Blvd., Suite N 112, Sacramento, CA 95834, or by phone at (916) 445-1254 or (800) 952-5210.
